Terms and Conditions
Preamble
The following terms and conditions are concluded betwen, the company Oddune, 7 Avenue Paul Clap, 13620 CARRY-LE-ROUET, FRANCE, phone +33638236178 registred : RCS AIX EN PROVENCE n°508 964 236 hereafter denoted "Oddune" , initial capital 10 000€, VAT n° FR06508964236 and with customers that access and use the website Oddune.com (http://www.oddune.com) hereafter denoted "customer".
These terms and conditions shall be governed by and construed in accordance with French Law and it is agreed that the French court shall have exclusive jurisdiction in the event of a dispute. Oddune will respect the french regulation about mail-order selling.
By placing an order the customer agree to be bound by the terms and conditions set out below.
1. SUBJECTThese terms and conditions regulate the purchase on Oddune.
2. PRODUCTS AND AVAILABILITYPorducts and prices online are guarented one day. Items are subject to availability. If the order or part of the order becomes out of stock or if the delivery delay is up to 30 days from the delivery delay given at the order, the customer could ask to be refunded.
In accordance with the French law (art 111-1 code consommation), Oddune takes all reasonable care to ensure that all details, descriptions, measurements using of products appearing on the website are correct.
3. PRICESAll prices are inclusive of VAT the total cost of the order is the price of the products ordered plus the delivery charge.
The VAT rate is correct at the time of entering the information on to the system, it's subject to change. Prices are guarented one day. However prices are not subject to change once the order has been placed.
In case of creation of new taxes, for sustainable development for example, prices could be subject to change.
4. ORDERIn order to make a purchase the customer has to login using his email and password in the space "login". The customer has to register, the data is stictly personnal, in case of loss or forgetting the customer has to contact Oddune from the space "contact us".
When a customer places an order he accepts prices and product information. In case of a complaint that product could be subject to exchange.
When the customer places an order, the order is confirmed via an email. The customer is able to track his order and view his order history in the space "My account".
5. DELIVERYOddune offer a standard delivery, the "Colissimo 48H" service is operated by the french Post. Oddune aims to deliver all mainland France standard orders in 2 working days following the order is dispatched. In case of delay independent of the responsability of Oddune, we won't be held liable for this delay. For details about prices and delivery times please refer to the spaces "Help" and "Delivery" on the website.
6. PAYMENT OPTIONS AND SECURITY
Orders are paid with credit cards online. Prices are in Euros. Oddune is working together with the secure system "Sherlock's" operated by Le Crédit Lyonnais (LCL) bank.
We use industry-standard Secure Sockets Layer (SSL) technology to allow for the encryption of potentially sensitive information such as your name, address and other critically sensitive information like your credit card details. Information passed between your computer and our website cannot be read in the event someone else intercepts it.
7. DAY COOLING-OFF PERIOD / RETURNS / EXCHANGES / DAMAGES7 DAY COOLING-OFF PERIOD :
Customers have seven working days (beginning the day of receipt) to cancel the purchase. In this case, we will provide an exchange or a full refund (item price and posting cost) but you must return the cancelled items to us. Customer won't be charged except the return posting cost.
The time of 7 days is extended when you are enable to cancel your purchase due to the impossibility to get around or due to other reasons concerning your proper existence.
When the time of 7 days ends on a Saturday, a Sunday or a day off, it's extended to the next working day.
Item must be returned with the return form provided at the delivery, item must be returned at the following address :

A return code must be typed on the return form. The customer will find the return code on the invoice.
Exchange or refund will be accepted only if :
- item must be returned within 7 working days
- item must be returned as possible in it's original packaging and without damages
- item is unworn or washed
- item must be without fault except if the faulty has been declared to Oddune at the delivery
- it's important to use a Recorded Delivery as this proves that you sent it back to us if it gets lost in transit.
Oddune will check the statement of the item, and accept or not the item.

In accordance with the article L121-20-1 "code de la consommation" item is refunded as quick as possible and within 30 days following the customer' s request.
Exchanges :
Item will be exchanged, if it's out of stock the item will be refunded. In case of exchange if the new price is higher customer will pay the difference. If the new price is lower customer will be refunded the difference.
Damages :
The customer must check if the item is in good condition. Customer must declare any fault within 5 days from receipt by mail to : Oddune, 7 avenue Paul Clap, 13620 CARRY LE ROUET or by email : info@oddune.com
The fault must be proved by the customer.
After 5 days time without claim, item would be considered in good condition.
Item will be exchanged and at the Oddune cost.
8. GUARANTIESItem are guaranteed, in accordance with the articles 1641 to 1649 Code civil and L211-4 to L211-17 Code de la consommation. The guarantee allowed the customer to be refunded, or to exchange the item if it's not as per order.
9. SIGNING AND PROOFThe confirmation of the order proves the order and payment can be asked (13th march 2000 Law). This confirmation means a full acceptation from the customer. If the customer has any problem with his credit card (fraud...) he should contact Oddune.
The order register is kept secure in Oddune's files, it is a proof of communication, order, payments.
Oddune won't be held liable in case of unforseen fact or in case of any arising damages not caused by our negligence. Oddune won't be liable if for any reason the website is unvailable at any time for any period. Oddune will not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of this Website or to your downloading of any material posted on it, or on any website linked to it.
10. PRIVACY POLICYIn accordance to the Act (6 Janvier 1978 Law) the customer has the right to control and update his personal information via the space "My account" or via mail : Oddune, 7 avenue Paul Clap, 13620 CARRY LE ROUET, FRANCE.
The customer data will enable Oddune to send him information about products and services and details of promotions and special offers from Oddune. If you do not wish to be contacted for these purposes ask it via "My account".
We will not pass your information on to other companies for marketing purposes unless you have agreed for us to do so in the space "My account". Oddune is authorised to collect and use customer information, autorisation n° 1339523, 9th of january 2009.
11. INTELLECTUAL PROPERTYAll rights, including copyright, in this website are owned by or licensed to Oddune. Any use of the site or its contents, including copying or storing it or them in whole or part, other than for your own personal, non-commercial use is prohibited without the permission of Oddune. Any link to Oddune using framing or in-line linking is prohibited. Any link is prohibited without the permission of Oddune.
12. ENTIRE AGREEMENTThe above terms and conditions constitute the entire agreement of the parties and supersede any and all preceding and contemporaneous agreements between you and Oddune. Any waiver of any provision of the terms and conditions will be effective only if in writing and signed by Oddune.
13. VARIATIONOddune shall have the right in its absolute discretion at any time and without notice to amend, remove or vary the terms and conditions.
14. ARCHIVESVouchers and any documents are kept secure on the website in accordance to the article 1348 code civil.
15. GOVERNING LAW AND JURISDICTIONThese terms and conditions are to be construed in accordance with the laws of France and in the event of any dispute or claim associated with these terms and conditions, that dispute or claim shall be subject to the exclusive jurisdiction of the French courts.
16. TERMS FOR THE ARTthe art presented on the website are not sold by Oddune. To purchase art, the customer must directly contact the artist, all the contact information is given on the website. Oddune can't be liable for these kind of purchase. |
